UCLA legal scholar Jocelyn Samuels, who ran the HHS civil rights office in the Obama administration, said the Trump administration would be going beyond established law if it adopted the policy in the memo.

Trump confirmed Monday that a policy change toward transgender people was under consideration but said that there is more than one way to approach the issue.

The memo touched off a fierce backlash on social media, fuelled by the hashtag "WontBeErased" and joined enthusiastically by a number of Democratic lawmakers, including two widely seen as potential presidential hopefuls in 2020: California's Kamala Harris and Elizabeth Warren from MA.

"You could potentially say that's going to rally up the socially conservative base, but I think on the flip side, it's not helpful to them", said Cafaro, a former Democratic minority leader in the OH state senate.

The Trump Administration is considering defining gender as a person's sex assigned at birth.

"Sex means a person's status as male or female based on immutable biological traits identifiable by or before birth", the draft memo reads. It said additionally that HHS officials were looking to a 2016 federal court ruling on a provision of Obamacare, where Judge Reed O'Connor said, "Congress did not understand "sex" to include 'gender identity'".

According to the Times, HHS "has called on the "Big Four" agencies that enforce some part of Title IX - the Departments of Education, Justice, Health and Human Services, and Labor - to adopt its definition in regulations that will establish uniformity in the government and increase the likelihood that courts will accept it".

Asked about a campaign promise to protect the LGBT community, Trump said: "I'm protecting everybody. So, it's not going to happen and I'm not anxious about it, because we have been fighting this fight forever and nothing is going to change that", she added. "Transgender people are our neighbors, coworkers, friends, and family members, and they deserve to live their lives with dignity and respect".

"I'm protecting everybody", he added. I am livid but clear-headed.

Dr. Joshua Safer, executive director of Mount Sinai Hospital's Center for Transgender Medicine and Surgery, said the Trump administration's definition is "not consistent with current western medicine or science in terms of how we actually operate or define sex of individuals".

An alarming story in today's New York Times revealed how the Trump administration plans on narrowly defining gender, in effect putting to an end changes to gender politics that the Obama administration initiated.

Earlier this month, the State Department implemented a policy denying visas to same-sex partners of foreign diplomats and the staff of USA -based global organizations if they are not legally married. Many protests have been held across the country since the announcement.
