Jennifer Hudson's Ex Gets Primary Custody Of Their Son

Sources close to Otunga reportedly do not believe that Hudson was being generous or was considering their son's best interests when she dropped the protective order.

"David Otunga has been trying to negotiate the terms of an amicable parenting agreement with Ms. Hudson for several weeks now", attorney Tracy Rizzo said in an interview with TMZ. David Jr.is now with Otunga while Hudson works in London.

Word is that both parties agreed to this new custody situation considering that she is in London filming "The Voice UK" and still has heavy commitments with "The Voice" back in Los Angeles.

A source told TMZ that Otunga will have custody of the 8-year-old child for majority of the time, as Hudson will be traveling for work.

A representative for Hudson provided CNN with a statement Friday, saying the pair "have been in the process of ending their relationship for a number of months". In the original request for the order, Jennifer claimed she had been "living in fear" of her former fiance.

David has been the primary parent in Jr.'s life because JHud is infinitely busier than he is on a regular basis. "Jennifer's actions are exclusively taken in the best interest of their son".

To be clear, Jennifer has never accused David of physically hurting or threatening their child.

The retired wrestler has vehemently denied Hudson's allegations.

Hudson and the Harvard Law grad got engaged in 2008 after a couple of months of exclusively dating. She also alleged he left a gun out on the counter, which she is "very sensitive" about considering her family history where her mother, brother and 7-year-old nephew were shot to death. Their son was born in August 2009.
